  • Engage Elevaite’s marketing, AI-driven lead generation, and paid advertising services under a separate service agreement.

4.2 Automated Services

You acknowledge and consent that Elevaite may employ AI-driven voice agents, chatbots, and automated messaging ("Automated Services") to contact, qualify, and follow up with leads on behalf of clients. Automated interaction recordings and transcripts are governed by our Privacy Policy.

4.3 Paid Advertising Services

Elevaite may manage paid advertising campaigns on platforms such as Facebook, Google, and others. All ad creative, targeting, and budgeting are subject to platform policies. Elevaite does not guarantee performance metrics or placement and is not liable for changes in third-party platform rules.

4.4 Prohibited Activities

You agree not to:

  • Violate any law, regulation, or third-party rights.
  • Reverse engineer or tamper with the Site.
  • Use bots/scrapers without written consent.
  • Harvest personal data of others.
  • Upload harmful code or malicious content.
  • Impersonate any person or entity.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ELEVAITE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES, OR FOR LOST PROFITS, REVENUE, OR DATA, ARISING FROM YOUR USE OF THE SITE OR SERVICES. ELEVAITE’S AGGREGATE LIABILITY SHALL NOT EXCEED THE GREATER OF (A) THE FEES PAID BY YOU FOR SERVICES IN THE SIX MONTHS PRIOR TO THE CLAIM OR (B) $100 USD.

You agree to indemnify and hold harmless Elevaite, its officers, directors, employees, and agents from any claims, liabilities, losses, or expenses (including reasonable attorneys’ fees) arising from your breach of these Terms or your use of the Site or Services.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Province of Alberta, Canada, without regard to conflict-of-law principles. Disputes shall be resolved in the courts of Edmonton, Alberta, and you consent to their jurisdiction.

If any provision is held invalid, the remaining provisions remain in full force and effect.

12. Waiver

No waiver of any breach constitutes a waiver of any subsequent breach.
